II. For which purposes and on which legal basis do we process personal data?

a) Visiting our website
If visiting out website for information purposes only, i.e. if you do not register or communicate other information to us, we only collect the personal data transferred to us by your browser.

- IP address- Date and time of the request
- Content of the request (specific page)
- Access status/HTTP status code
- Website from which the request comes (referrer)
- Operating system and its interface
- Language and version of the browser software.

We also save this data, including the IP address, in log files.

We require such data technically to display our website, to ensure its stability and security and to optimise our offer.

The legal basis for this is Article 6 Paragraph 1 lit. f GDPR, whereby our legitimate interest originates from the above-specified purposes.

We delete this data after seven days at the latest. Storage exceeding this period only takes place after the personal data was deleted or anonymised. In the case of IP addresses, the anonymisation can take place via appropriate shortening.

b) Cookies
We use cookies on our web pages. Cookies are small text files saved to your system that enable specific information to flow to us.

We use transient and persistent cookies on our website. Transient cookies are deleted automatically if you close the browser. These include in particular the session cookies. These save a so-called session ID that enable the various requests of your browser to be assigned to a common session. This enables your computer to be recognised again if you return to our website. If you do not confirm your registration within 24 hours your data is automatically deleted. Furthermore, we also save your used IP addresses and the times of your registration and confirmation. The purpose of this process is to verify your registration and to possibly explain any misusage of your personal data.

The only obligatory specification for the newsletter registration is your email address. After your confirmation we save your email address for the purpose of sending the newsletter.

The legal basis is your consent according to Article 6 Paragraph 1 lit. a GDPR.

We evaluate your user behaviour with web beacons in order to statistically evaluate our newsletter campaigns and to adapt future newsletters to the interests of recipients. You can object to this by unsubscribing from the newsletter.

For sending the newsletter we use Emarsys Interactive Services GmbH, Stralauer Platz 34, 10243 Berlin as a technical service provider. d) Contact form
If you use our contact form we use the data provided by you, whereby for responding to your request only one valid email address is required and the other specifications are voluntary. Your data may be stored in a customer relationship management system (“CRM system”) or a comparable system.

The data processing for purposes of establishing contact with us is implemented on the basis of Article 6 Paragraph 1 lit. b GDPR if your request concerns the fulfilment of contractual obligations or the commencement of contractual negotiations. In other cases the legal basis for this is contained in Article 6 Paragraph 1 lit. f GDPR, whereby our legitimate interest originates from the above-specified purposes.

The personal data collected by us for use of the contact form is automatically deleted after completion of your request if we are not legally obligated to store this or if we require the data for contract fulfilment. You can contradict the processing at any time if this processing is implemented on grounds of a legitimate interest.

e) Email contact
If you contact us via the email addresses we specified, we save the personal data communicated by you for the purpose of responding to your requests. Your data may be stored in a customer relationship management system (“CRM system”) or a comparable system.

The legal basis for this is Article 6 Paragraph 1 lit. f GDPR, whereby our legitimate interest originates from the above-specified purposes. If establishing contact aims at concluding a contract or is part of an existing contractual relationship, the legal basis is Article 6 Paragraph 1 lit. b GDPR.

The data will be deleted if the request was definitely processed, or if we are not legally obligated to storage or do not require the data for contractual fulfilment. You can contradict the processing at any time if this processing is implemented on grounds of a legitimate interest.

f) myERCO
If you use the myERCO service, during the collection of articles the first three octets of the IP address as well as date and time are saved. The user ID is also saved with registered users.

If you register, we create a user account for you and save the data you specified. You can delete this user account at any time in the user area.

If you create a quotation request via myERCO the personal data required for creating the quotation is collected. Mandatory information is marked as such and other information is voluntary.

The legal basis is Article 6 Paragraph 1 lit. b GDPR.

We also process your data, in particular your email address, to inform you about other interesting products from our range. The legal bases in this case are Article 6 Paragraph 1 lit. f GDPR, Article 7 Paragraph 3 UWG (Unfair Competition Act). You can revoke this use at any time.

For reasons relating to commercial and fiscal law we are liable to store your address, payment and order data for a period of up to ten years. However, we restrict processing after two years, i.e. your data will only be used to comply with legal obligations.

g) Data processing for contract initiation / fulfilment and direct advertising
We process data that we receive from you in connection with the initiation and processing of a contract for the purpose of processing the contract on the basis of Article 6 Paragraph 1 lit. b GDPR.

We also process your data, in particular your email address, to inform you about other interesting products from our range. The legal bases in this case are Article 6 Paragraph 1 lit. f GDPR, Article 7 Paragraph 3 UWG. (Unfair Competition Act). You can revoke this use at any time.

For reasons relating to commercial and fiscal law we are liable to store your address, payment and order data for a period of up to ten years. However, we restrict processing after two years, i.e. your data will only be used to comply with legal obligations.

We also store your data in a central database operated on our behalf by Emarsys eMarketing Systems AG and Emarsys Interactive Services GmbH, Stralauer Platz 34, 10243 Berlin. Data on orders placed is stored in the database and statistically analysed. This processing serves our legitimate interest pursuant to Article 6 Paragraph 1 lit. f GDPR for the statistically based optimisation of our online offer.

h) Emarsys - Web Extend
We use the “Web Extend” service of Emarsys eMarketing Systems AG and Emarsys Interactive Services GmbH, Stralauer Platz 34, 10243 Berlin, for the targeted implementation of marketing measures. The service enables us to extend existing databases with further information concerning user behaviour on our website. Our service provider uses JavaScript and cookies for this purpose.

The legal basis is your consent according to Article 6 Paragraph 1 lit. a GDPR and Section 25 (1) TTDPA. You can revoke your consent at any time.

We have concluded an order processing agreement with our service provider in accordance with Article 28 GDPR.

i) Facebook Pixel
We use the so-called facebook pixel on our website. The legal basis for the use is your consent and thus Article 6 Paragraph 1 lit. a GDPR.

Your data will be forwarded to Meta Platforms Inc. (www.facebook.com). Meta Platforms Inc. has submitted to the Data Privacy Framework (DPF) (dataprivacyframework.gov), so that possible third country transfer to the USA is justified by the corresponding adequacy decision of the EU Commission. j) Vimeo videos
We integrate videos from the “Vimeo” platform. The provider is Vimeo Inc., 555 West 18th Street, New York, New York 10011, USA. In particular, the transmission of the IP address is necessary for the provider to be able to transmit the contents.

k) Applicant data
If you send us your application, we will process the data submitted to us in order to fulfil our (pre)contractual obligations within the application procedure. If your application is successful, we process the data for the purpose of carrying out the employment relationship.

The legal basis is Article 6 Paragraph 1 lit. b GDPR and Paragraph 26 BDSG. If you voluntarily provide us with special categories of personal data, such as health data or religious affiliation, the legal basis is additionally Article 9 Paragraph 2 lit. b GDPR. If your application is not successful, we will delete your data after six months at the latest. The data will be stored until then in order to answer any questions regarding the application procedure and to fulfil our obligations under the AGG. If you withdraw your application, we will delete your data immediately.

l) Adform
On this website we use the tool Adform from Adform A/S Wildersgade 10B, sal. 1 DK-1408 Copenhagen, Denmark, which collects data for analysis, marketing and optimisation purposes to help us improve our marketing measures and our website. The data collected is used by Adform to link advertising contacts and clicks on advertisements with a resulting use of our website. In this way we can determine whether internet users who have seen our advertisements visit our website and which products they are interested in. This helps us to use our advertising budget more efficiently. The data collected can also be used by us to supply advertising based on their interests (e.g. products viewed). m) Hotjar
We use Hotjar for the optimisation of our offer. This tool enables us to measure user behaviour on our website. It enables us to determine how much time users spend on which pages, which links they click on and what particularly interests them. We also process IP addresses in anonymised form and information about the browser you use, your operating system, monitor size, device type, location (country) and preferred language.

We use the services of Google Ads to draw attention to our offers with the help of advertising material on external websites. In relation to the data of the advertising campaigns, we are able determine how successful the individual advertising measures are. With this, we aim to show you advertising which is of interest for you, which makes our website more interesting for you and which achieves a fair calculation of advertising costs.

These advertising measures are supplied by Google via so-called “Ad Servers”. For this purpose we use Ad Server cookies, which can be used to measure certain parameters for success assessment such as the display of ads or clicks by users. If you access our website via a Google advertisement, Google Adwords stores a cookie on your PC. These cookies usually lose their validity after 30 days and are not intended to identify you personally.
